Restrictions: You may not:

• Redistribute, resell, or sublicense our prompts as standalone products
• Create competing prompt libraries using our content
• Remove or alter any copyright or proprietary notices

5. Payment Terms

Subscription Plans: We offer premium subscription plans with access to exclusive content and features. Current pricing is displayed on our pricing page and may be updated from time to time.

Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. Payment is due immediately upon subscription and on each renewal date thereafter.

Auto-Renewal: Subscriptions automatically renew unless cancelled before the next billing cycle. You can cancel your subscription at any time through your account settings.

Price Changes: We reserve the right to modify subscription prices with 30 days' notice to existing subscribers.

6. Refund Policy

General Policy: All subscription sales are final. Your subscription grants immediate access to premium features, resources, and tools, which are made available upon purchase. This policy ensures fairness to all users and helps us maintain the quality and continuity of our services. For this reason, we do not offer refunds except in very limited circumstances outlined below.

• Technical Issues – You experience a service-wide technical problem that prevents you from accessing the platform for more than 48 consecutive hours, and the issue is verified by our support team.
• Billing Errors or Unauthorized Charges – You were incorrectly billed or charged without authorization.
• Early Cancellation with Minimal Usage – You cancel within 24 hours of your initial subscription purchase and have made only minimal use of the premium features. “Minimal use” is determined solely at our discretion based on usage logs.

Refund Requests: To request a refund, contact us within 7 days of the charge. We will review each request on a case-by-case basis.

Processing: Approved refunds will be processed within 5-10 business days to the original payment method.

7. Limitation of Liability and Disclaimers

Service "As Is": Our service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Results: We do not guarantee that our prompts will work for every use case or produce specific results. The effectiveness of prompts may vary depending on the AI platform, model version, and specific implementation.

Limitation of Liability: To the maximum extent permitted by law, Promptava shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Maximum Liability: Our total liability to you for any claims arising from these Terms or your use of our service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Account Termination

Your Right to Terminate: You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

Our Right to Terminate: We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse our service or other users
• Fail to pay subscription fees

Effect of Termination: Upon termination, your access to premium content will cease immediately, and we may delete your account data in accordance with our Privacy Policy.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
